The protection of your personal data is very important to us. At MindfulMotion, we are committed to data protection. We place great value to compliance with all applicable laws and we process your personal data exclusively in line with the requirements set out in the General Data Protection Regulation (”GDPR”) and all other relevant laws. We will only process and store your personal data to the extent required.

This privacy policy is intended to help you understand how your personal data is processed when you use the services of MindfulMotion. MindfulMotion reserves the right to update this policy as needed or as required by law. Any changes thereto will be effective for you upon being communicated to you (e.g. by prompting it on a website that you are visiting).

[2] What data do we process?

Our primary goal in collecting information is to provide and improve MindfulMotion (”App”) and to enable users to enjoy the App.

Usage Data: We collect data about how you interact with the App. When you use the App, we process usage data, namely the sections of the app you visit, the features you use, and the frequency of access.

If you decide to provide an email for effective communication, we will process your email data for the purpose of contacting you and processing your request. Any provision of email is done on a strictly voluntary basis. The legal basis for such processing is performance of contractual obligations or implementation of corresponding pre-contractual measures according to Art 6 para l lit b GDPR and legitimate interest according to Art 6 para l lit f GDPR: processing and answering inquiries.

The personal data is stored for the duration of the business relationship and beyond that in accordance with the statutory storage and documentation obligations; beyond that until the end of any legal dispute between us.

You have the following rights:

     

      • Right of access: You can request confirmation as to whether and to what extent data about you is being processed.

      • Right to rectification: If we process incomplete or incorrect data from you, you can request their correction and completion at any time.

      • Right to erasure: You can request deletion of your data if the purpose for which it was processed has ceased to exist, there is unlawful processing, you object to the processing as it unlawfully and disproportionately interferes with your legitimate interests in the protection of your data, or the data processing is based on your consent and you have revoked it. It should be noted that there may be other reasons which may prevent the immediate deletion of your data, e.g. statutory retention obligations, pending proceedings, assertion, exercise or defence of legal claims etc.

      • Right to restriction of processing: You have the right to request the restriction of processing of your data if:

           

            • you dispute the accuracy of your data, for a period of time that allows us to verify the accuracy of your data;

            • the processing of your data is unlawful, but you refuse to have it erased and instead request restriction of data;

            • we no longer need the data for the intended purpose, but you still need this data to assert, exercise or defend a legal claim; or

            • you have objected to the processing of the data as long as it has not yet been determined whether our legitimate reasons outweigh yours.

        • Right to data portability: You may request us to provide you with the data you have provided us in a structured, commonly used and machine-readable format or to transfer this data to another controller without hindrance from us, provided that we process the data on the basis of your consent or for the performance of contractual obligations between us and the processing is carried out by automated means.

      Right to withdraw consent: You can revoke declarations of consent made to us at any time without giving reasons, whereby you can revoke each individual declaration of consent independently of other declarations of consent made to us.

      We expressly point out that such a revocation has no direct or indirect negative consequences for your contractual relationship with us. The only consequence of a revocation is that we will no longer process your data from this point in time for the purposes stated in the respective declaration of consent, and any rights and/or benefits, if any, associated with processing of the specific data can no longer be claimed.
